на сколько я помню что в законе, то там 5 календарных лет проживания, из которых какое то число дней можно было провести за границей

что то вроде около 6-9 месяцев вроде, за весь период

а вспомнил где читал, в директиве 2003/109/EC, на основе которого оно в теории должно прецеситься:

- To obtain long-term resident status, non-EU citizens must have lived legally and continuously in an EU country for 5 years
- Absences of less than 6 consecutive months and no more than 10 months over the whole period are permitted when calculating the 5 years.

и дословно там так:
Periods of absence from the territory of the Member State
concerned shall not interrupt the period referred to in paragraph 1 and shall be taken into account for its calculation
where they are shorter than six consecutive months and do not
exceed in total 10 months within the period referred to in
paragraph 1.
